1. Introduction and Governance
The Restoration Guys, LLC (“we,” “us,” or “our”) acts as a “Business” and “Data Controller” regarding the personal information collected through our digital properties. In accordance with U.S. state privacy laws, we collect and process personal information only to the extent it is reasonably necessary and proportionate to achieve the specific, disclosed purposes in this SMS Privacy Policy (the “Policy”). This Policy describes how we collect, use and disclose your personal information in connection with your use of our short message services and/or multi-media services for marketing and non-marketing purposes from us through the Hatch software program (the “SMS Services”).
Please read this Privacy Policy carefully. By enrolling in, using or accessing any of the SMS Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use or access any of the SMS Services. This Policy is incorporated into our Terms of Service covering SMS Services, is strictly limited to the SMS Services described herein, and does not relate to the collection or use of personal information through any of our other services.
2. Notice at Collection: Information Collected About You When Using SMS Services
We collect information that identifies or relates to you (“Personal Information”). The Personal Information we collect about you through your use of the SMS Services is provided by you directly when registering to use the SMS Services, and includes your full name, phone number, and email address. We may use cookies or similar technologies on our website therestoguys.com or websites associated with the SMS Services to automatically collect your interactions therewith.
We do not intentionally collect categories of Sensitive Personal information, including, without limitation, your social security number, precise geolocation, or biometric data. If we discover any such data has been inadvertently collected, we will take steps to delete it or obtain the requisite affirmative consent.
3. Retention of Personal Information for SMS Services
We retain your Personal Information according to the following criteria, unless a longer period is required or permitted by law, or to establish, exercise, prosecute, or defend legal claims.

4. Use of Personal Information for SMS Services
We use your Personal Information to provide you with timely communications regarding your project with us, our Business Relationship, and other relevant information relating thereto. We may also use your Personal Information to market our products and services to you and request feedback following completion of your project, including by the SMS Services, with your consent.
5. Disclosure of Personal Information: Third-Party Relationships
We may use third-party SMS Services providers, including Hatch, to assist us with providing and marketing our services to you, and we may disclose your Personal Information with third-parties for these limited purposes. Where these parties act on our behalf, they are contractually restricted from using your information for any purpose other than providing services to us. We do not share text message opt-in consents or related mobile telephone numbers with third parties outside of those detailed above.
We may also share your Personal Information if necessary to comply with any applicable law, in response to service of a subpoena, search warrant, or other lawful request for information we receive, in the event our company is purchased by or merges with another company, and/or to otherwise protect our rights or property.
6. Your Privacy Rights and Opt-Out Mechanics
Depending on your state of residence, you may have the right to access, correct, or delete your data, and opt-out of the SMS Services. You may also exercise your opt-out rights by replying STOP, OPT-OUT, or CANCEL to any text message sent from us.
7. Process to Correct, Verify, Change, or Remove Personal Information
All requests to correct, verify, change, or remove your Personal Information should be submitted via the Request Form found on our website, which can be accessed here. We will verify all requests by matching provided data against our internal records. We reserve the right to request additional information (e.g., a signed declaration) to verify your identity for high-risk requests, such as removal. We respond to all requests within forty-five (45) days. We may extend this by an additional 45 days where permitted and necessary, provided we notify you within the initial period.
8. Appeals and Regulatory Contact
If we decline your request, you may appeal by contacting webmaster@therestoguys.com within 30 days. We will provide a written explanation of our decision within 60 days, including information on how to contact the relevant regulator. In California, you may contact the California Privacy Protection Agency (CPPA) and for all other States, contact their respective State Attorney General.
9. Security and Children’s Data
We utilize industry-standard safeguards, including HTTPS/SSL encryption for data in transit, to protect Personal Information. We do not knowingly collect or share Personal Information from individuals under 16 years of age.
