SMS Services Terms & Conditions

1. Program Description

The Restoration Guys, LLC (“we,” “us,” or “our”) operates an SMS messaging program (the “SMS Program”) through the Hatch software platform. The SMS Program is used to communicate with customers and prospective customers regarding: (a) active restoration projects; (b) scheduling, estimates, and project updates; (c) account and billing matters; and (d) marketing and promotional messages relating to our services, where you have provided your consent to receive such communications. These Terms & Conditions (“Terms”) govern your participation in the SMS Program and should be read in conjunction with our SMS Privacy Policy, which is incorporated herein by reference.

2. Consent and Enrollment

By providing your mobile telephone number and enrolling in the SMS Program, you expressly consent to receive recurring automated text messages from The Restoration Guys, LLC at the mobile number you provide. Your consent to receive text messages is not a condition of purchasing any goods or services from us. Standard message and data rates may apply. Message frequency will vary based on your project status, account activity, and the nature of our Business Relationship.

3. Message Frequency

Message frequency varies. You may receive transactional messages (e.g., project updates, scheduling confirmations) as needed throughout the duration of your project or Business Relationship. You may receive marketing or promotional messages periodically. We will not send messages excessively or for purposes unrelated to our services and our Business Relationship with you.

4. How to Opt Out (STOP Instructions)

You may opt out of the SMS Program at any time by replying STOP, OPT-OUT, or CANCEL to any text message you receive from us. After we receive your opt-out request, we will send you one final confirmation message and you will receive no further SMS Program messages. If you opt out of marketing messages, you may still receive transactional messages necessary to manage your active project or account, unless you opt out of all messages. To re-enroll in the SMS Program after opting out, contact us at the information provided in Section 9 below.

5. Help Instructions

For assistance with the SMS Program, reply HELP to any text message you receive from us, or contact us directly using the contact information in Section 9 below. We will respond promptly to your inquiry.

6. Message and Data Rates

Standard message and data rates may apply to all text messages sent and received in connection with the SMS Program. These charges are billed by and payable to your mobile carrier. We do not charge a separate fee for participation in the SMS Program. Contact your mobile carrier for details about your messaging plan.

7. Mobile Data Sharing

Mobile information, including your mobile telephone number and SMS opt-in consent, will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties except aggregators and providers of the text message services necessary to operate the SMS Program (including Hatch). All such providers are contractually restricted from using your information for any purpose other than providing services to us.

8. Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission from your network operator. Message delivery is not guaranteed, and The Restoration Guys, LLC is not responsible for delays or failures in message delivery caused by your carrier or network conditions.

11. Modifications to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to enrolled participants via text message or by updating the effective date of these Terms on our website. Your continued participation in the SMS Program following notice of any modification constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles, and are subject to applicable federal law, including the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and regulations promulgated thereunder.
